{"id":14725,"date":"2017-07-04T00:00:00","date_gmt":"2017-07-04T00:00:00","guid":{"rendered":"https:\/\/cms.fiveaa.com.au\/uncategorized\/killer-driver-s-sentence-won-t-be-challenged\/"},"modified":"2017-07-04T00:00:00","modified_gmt":"2017-07-04T00:00:00","slug":"killer-driver-s-sentence-won-t-be-challenged","status":"publish","type":"post","link":"https:\/\/cms.fiveaa.com.au\/news\/killer-driver-s-sentence-won-t-be-challenged\/","title":{"rendered":"Killer driver\u2019s sentence won\u2019t be challenged"},"content":{"rendered":"<h3>SA\u2019s Director of Public Prosecutions has decided not to appeal the sentence handed to the hoon driver who killed Adelaide mum Nicole Tucker in a fiery crash on the Southern Expressway last year.<\/h3>\n<p>Last month the teenage driver was jailed for three years and four months, but a backdated non-parole period meant he could be free in just 10 months.<\/p>\n<p>At the time, FIVEAA\u2019s David Penberthy called the sentence \u201c<a href=\"https:\/\/cms.fiveaa.com.au\/shows\/david-and-will\/david-and-will-blast-sentence-given-to-the-hoon-who-killed-adelaide-mum\"><strong>the most pathetically weak sentence<\/strong><\/a> in living memory ever handed down in South Australia\u201d.<\/p>\n<p>\u201cIt is simply unbelievable,\u201d Penbo said. \u201cHe\u2019s been tried like an adult and treated like a baby.\u201d<\/p>\n<p><strong>But in a statement on Tuesday morning, Director of Public Prosecutions Adam Kimber SC said he would not file an appeal against the decision.<\/strong><\/p>\n<blockquote><p>\u201cIt is only appropriate for me to appeal if I am of the opinion that there is an adequate prospect of the Court of Criminal Appeal concluding it was not open to the sentencing judge to impose the sentence she did,\u201d he said.<\/p>\n<p>\u201cHer Honour has sentenced according to law (and) the sentence is within the appropriate range given the principles the judge was bound to apply.<\/p>\n<p>\u201cThis being so, it would be inappropriate for me to appeal.\u201d<\/p>\n<\/blockquote>\n<p><strong>Attorney-General John Rau said the soft sentence was a fault \u201cwith the law &#8212; not the Judge, not the DPP\u201d.<\/strong><\/p>\n<p><strong>\u201cI will be advising the Parliament of legislative changes to deal with this problem later today,\u201d he said.<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" height=\"752\" width=\"1101\" class=\"media-element file-default nova-lazyload-image-wrapper lz-cont img-responsive\" data-delta=\"1\" src=\"https:\/\/cms.fiveaa.com.au\/wp-content\/uploads\/2020\/03\/screen_shot_2017-07-04_at_10.21.25_am.png\" alt=\"\" \/><\/p>\n<h3>MOST POPULAR<\/h3>\n<p><a href=\"https:\/\/cms.fiveaa.com.au\/sport\/Rival-club-tells-Crows-trade-target-isn-t-going-anywhere\"><strong>RIVAL CLUB TELLS CROWS: TRADE TARGET ISN\u2019T GOING ANYWHERE<\/strong><\/a><\/p>\n<p><a href=\"https:\/\/cms.fiveaa.com.au\/shows\/leith-forrest\/Michael-Voss-makes-a-MASSIVE-call-on-Port-player\"><strong>MICHAEL VOSS MAKES A MASSIVE CALL ON THIS PORT PLAYER<\/strong><\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>SA\u2019s Director of Public Prosecutions has decided not to appeal the sentence handed to the hoon driver who killed Adelaide mum Nicole Tucker in a fiery crash on the Southern Expressway last year.
