Malcolm Turnbull says the government acted properly in the case of former senator Bob Day, who has been ruled ineligible to have been elected last year.<\/h3>\n

The High Court, sitting as the Court of Disputed Returns, on Wednesday ruled the former Family First senator had indirectly benefited from the government’s lease arrangement on his Adelaide electorate office, in breach of section 44 of the constitution.<\/strong><\/p>\n

A High Court judge will now determine how a special count will work, but it is expected the South Australian senate seat will go to the second person on Family First’s ticket, lawyer Lucy Gichuhi.<\/p>\n

Labor says government ministers were advised the lease agreement with Mr Day was improper and should not have gone ahead with it.<\/p>\n

They say this advice was overlooked because of the conservative senator’s crucial vote in the tightly-held upper house.<\/p>\n

But Mr Turnbull said the government had acted appropriately:<\/strong><\/p>\n

“The circumstances surrounding Mr Day’s lease were brought to the attention of the Senate by the government,” Mr Turnbull told reporters in Sydney on Wednesday.<\/p>\n

“The orders made by the High Court were the orders sought by the government.”<\/p>\n<\/blockquote>\n

Shadow attorney-general Mark Dreyfus said the government had advice as far back as February 2014 that the lease should not go ahead.<\/p>\n

“Malcolm Turnbull turned a blind eye to doubts about Bob Day’s eligibility to be a senator because he wanted Mr Day’s vote to get his regressive legislation through the Senate,” Mr Dreyfus said.<\/p>\n

Mr Day, a former Liberal party candidate who was first elected to the Senate in 2013, quit parliament in November last year to deal with the fallout from the liquidation of his Home Australia group of companies.<\/p>\n

Ms Gichuhi received 152 first-preference votes in the 2016 election.<\/p>\n

There is still a possibility the special count could deliver the seat to former Labor senator Anne McEwen, who was a party to the case.<\/p>\n

She had argued for a special count which disregarded the above-the-line votes for Family First.<\/p>\n

Family First said it was disappointed with the decision.<\/p>\n

“The recount makes it still possible that Lucy Gichuhi could still be in the running for the Senate position, however it could also fall to another party,” state Family First leader Dennis Hood said in a statement.<\/p>\n

“We believe that Bob Day acted with integrity in his dealings with the government but unfortunately the advice he received about his office facilities proved incorrect.”<\/p>\n

The Australian Electoral Commission said it would await further directions from the High Court on the special count process.<\/p>\n

It’s been speculated Ms Gichuhi may be ineligible for parliament because of her past dual Kenyan-Australian citizenship.<\/p>\n

Family First lawyer Greg Griffin said the citizenship question was “not quite removed”.<\/p>\n

“Assuming that all goes well for her, the position of Lucy is that she is an Australian citizen and is eligible. But that is a matter that will ultimately be determined by the High Court,” he told reporters in Adelaide.<\/p>\n

Once the seat is filled, the coalition will need 10 crossbenchers – or the support of Labor – to pass legislation through the Senate.<\/p>\n

Attorney-General George Brandis and Special Minister of State Scott Ryan said the matter would return to the court “in the next few days” so orders can be given to the electoral commission to conduct the special count.<\/p>\n

They said a new senator would be sworn in when the Senate next meets on May 9.<\/p>\n

“This decision confirms the government took the appropriate action last year by proactively asking the Senate to refer the matter to the High Court,” they said in a joint statement.<\/p>\n
