Controversial far-right activist Nicholas Folkes has agreed not to host a tribute to the Cronulla riots on the 10th anniversary of the clashes, but says he will instead throw a halal-free barbecue.<\/h3>\n

Folkes has promised under oath not to host or address any “memorial” rally at Cronulla this weekend.<\/p>\n

But he insists every citizen of Australia has the right to throw a non-halal snag on the barbie.<\/p>\n

Mr Folkes and his anti-Islam Party For Freedom had planned to hold a rally and a procession on Saturday to mark the 10th anniversary of the Cronulla riots.<\/p>\n

But a NSW Supreme Court judge has prohibited the planned rally from going ahead and Mr Folkes has given a sworn undertaking not to address any gathering in the southern Sydney beachside suburb.<\/p>\n

Instead, he told the Federal Court on Friday that he wants to throw a halal-free barbecue.<\/p>\n

“As a citizen and as a free man of Australia, I have the right to go down there and throw a barbecue,” Mr Folkes told the court on Friday.<\/p>\n

Wearing jeans, a check shirt and a bow tie, Mr Folkes gave an undertaking to the court to alert Party for Freedom supporters – who refer to themselves online as “patriots” – via his websites and Facebook page that a planned rally at Don Lucas Reserve, just north of the Cronulla CBD, had been cancelled.<\/p>\n

During a brief courtside grilling, Mr Folkes also gave an undertaking not to “address a public assembly in the local government area of Sutherland Shire Council on Saturday the 12th December”.<\/p>\n

“I believe it is an unjust request, but I will submit to you, your honour,” Mr Folkes said.<\/p>\n

“I still propose to have a halal-free barbecue on the day.”<\/p>\n

The “patriots” sitting in the public gallery of the courtroom broke into chuckles as Mr Folkes pondered: “Is there any law stating that I’m not allowed to have a barbecue?”<\/p>\n

If he breaks with the undertakings offered he could be prosecuted for contempt and his property – including his home – may be seized.<\/p>\n

Another party to the federal proceedings, which were brought by the local council and community figure Jamal Rifi, proposed rally speaker Shermon Burgess, did not front court.<\/p>\n

It is understood Mr Folkes still intends to spend Saturday in the Cronulla area.<\/p>\n

Earlier on Friday, Justice Christine Adamson agreed to prohibit the planned event following an application by the NSW Police Commissioner.<\/p>\n

Sutherland Shire Mayor Carmelo Pesce said the decision was a win for the community.<\/p>\n

“The community has spoken and has taken on these people and the law was on our side,” he said.<\/p>\n

He was very confident that police would deal with anybody who decides to ignore the court’s decision.<\/p>\n

“Tomorrow is business as usual… people just need to be able to go about their business as normal,” he said.<\/p>\n
