{"id":24637,"date":"2015-02-18T00:00:00","date_gmt":"2015-02-18T00:00:00","guid":{"rendered":"https:\/\/cms.fiveaa.com.au\/uncategorized\/david-hicks-lawyer-says-client-now-innocent\/"},"modified":"2015-02-18T00:00:00","modified_gmt":"2015-02-18T00:00:00","slug":"david-hicks-lawyer-says-client-now-innocent","status":"publish","type":"post","link":"https:\/\/cms.fiveaa.com.au\/news\/david-hicks-lawyer-says-client-now-innocent\/","title":{"rendered":"Lawyer says Hicks now innocent"},"content":{"rendered":"<h6>Image | sbs.com.au<\/h6>\n<h3>Australian David Hicks&#8217; terrorism conviction has been overturned by a US military court at Guantanamo Bay, bringing an end to an almost decade-long legal saga.<\/h3>\n<p>His lawyer Stephen Kenny said Hicks was now an innocent man with no convictions on his record.<\/p>\n<p>&#8220;It will be the end of people calling him a terrorist,&#8221; he told ABC Radio on Thursday soon after the verdict came through.<\/p>\n<p>&#8220;Frankly, he should never have been in Guantanamo Bay.&#8221;<\/p>\n<p>Hicks had pleaded guilty in March 2007 to providing material support to terrorism.<\/p>\n<p>This was part of a plea bargain which allowed most of his seven-year sentence to be suspended and Hicks to return to Australia.<\/p>\n<p>In 2014, a US appeal court ruled that providing material support to terrorism wasn&#8217;t a legally viable war crime under the jurisdiction of the Guantanamo court in Cuba.<\/p>\n<p>Prosecutors had argued his conviction should stand because he had agreed not to appeal as part of the plea deal.<\/p>\n<p>But this argument was rejected in an unanimous decision by the US Court of Military Commission Review.<\/p>\n<p>The US government has not said whether or not it will attempt an appeal, but Mr Kenny believes it won&#8217;t.<\/p>\n<p>Mr Kenny said his client was a happy man.<\/p>\n<p>&#8220;He&#8217;s very pleased his name was cleared but disappointed he was forced to remain in Guantanamo Bay for so long,&#8221; he said.<\/p>\n<p>Hicks could celebrate with a special dinner on Thursday night, he added.<\/p>\n<p>Mr Kenny said Hicks could potentially seek compensation from the Australian government but his legal team would have to show there was evidence it had played a role in his five-year detention at the US navy base at Guantanamo Bay.<\/p>\n<p>&#8220;At this stage, it&#8217;s pretty much the end of it for David,&#8221; he said.<\/p>\n<p>Mr Kenny said Hicks was getting his life back on track, living and working in Sydney, following his experience of torture and solitary confinement.<\/p>\n<p>Hicks&#8217; father, Terry Hicks, said he was still trying to take in the court&#8217;s decision.<\/p>\n<p>&#8220;It&#8217;s been a long road,&#8221; he told ABC radio.<\/p>\n<p>&#8220;It&#8217;s pretty hard to take it in at the moment.&#8221;<\/p>\n<p><strong>SEE ALSO: <a href=\"https:\/\/cms.fiveaa.com.au\/news\/two-arrested-after-16kg-meth-haul\">TWO ARRESTED IN ADELAIDE METH BUST<\/a><\/strong><\/p>\n<p><strong>SEE ALSO: <a href=\"https:\/\/cms.fiveaa.com.au\/shows\/david-mark-jane\/imported-food-needs-closer-look\">IMPORTED FOOD NEEDS CLOSER LOOK<\/a><\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Image | sbs.com.au Australian David Hicks&#8217; terrorism conviction has been overturned by a US military court at Guantanamo Bay, bringing an end to an almost decade-long legal saga.
