South Australian legislation concerning which criminals are and are not eligible for home detention is \u201cdeficient\u201d, says the state\u2019s former director of public prosecutions.<\/h3>\n

\u201cThe act was deficient in the sense that it did not specify what crimes home detention would be available for,\u201d Stephen Pallaras has told Leon Byner on FIVEAA. \u201cSo we\u2019ve left it up to the courts to try and work out what the parliament meant.\u201d<\/p>\n

\u201cIn other states we\u2019ve got some guidance from the courts\u2026 relatively minor offences like driving disqualified and minor theft get home detention.<\/p>\n

\u201cWhere a man has been given home detention bail on a charge of attempted murder it\u2019s clear that that doesn\u2019t fall into low risk or non violent offending.\u201d<\/p>\n<\/blockquote>\n
