{"id":30229,"date":"2016-12-05T00:00:00","date_gmt":"2016-12-05T00:00:00","guid":{"rendered":"https:\/\/cms.fiveaa.com.au\/uncategorized\/bad-childhoods-reduce-culpability-says-chief-justice\/"},"modified":"2016-12-05T00:00:00","modified_gmt":"2016-12-05T00:00:00","slug":"bad-childhoods-reduce-culpability-says-chief-justice","status":"publish","type":"post","link":"https:\/\/cms.fiveaa.com.au\/show\/bad-childhoods-reduce-culpability-says-chief-justice\/","title":{"rendered":"Bad childhoods reduce \u201cculpability\u201d, says chief justice"},"content":{"rendered":"<h3>Chief Justice Chris Kourakis says offenders from dysfunctional childhoods have less \u201cmoral culpability\u201d.<\/h3>\n<p>Mr Kourakis made the comments while rejecting an appeal against the length of sentences for David George Rigney-Brown and Ethram Ronald Hughes after they assaulted and robbed a taxi driver.<\/p>\n<p>\u201cWe all know the great responsibility of parents is to instil an idea of right and wrong in children,\u201d Chief Justice Kourakis told Leon Byner, \u201cto give them security to develop in to responsible adults.\u201d<\/p>\n<p>\u201cThe fact is that from a very early age both these young men did not have them.\u201d<\/p>\n<h3>LISTEN HERE:<\/h3>\n<p><iframe loading=\"lazy\" frameborder=\"no\" height=\"166\" scrolling=\"no\" src=\"https:\/\/w.soundcloud.com\/player\/?url=https%3A\/\/api.soundcloud.com\/tracks\/296423537&amp;color=ff5500&amp;auto_play=false&amp;hide_related=false&amp;show_comments=true&amp;show_user=true&amp;show_reposts=false\" width=\"100%\"><\/iframe><\/p>\n<p>\u201cThat doesn\u2019t give them a get out of jail free card,\u201d he said\u2026 \u201cbut it is a factor that makes their offending different to other kids.\u201d<\/p>\n<p>\u201cIf someone has all the advantages of a proper upbringing\u2026 that will count against them.\u201d<\/p>\n<p>In his judgement, Chief Justice Kourakis said:<\/p>\n<p>\u201cThrough no fault of their own, (the men) did not develop adult insights, values and responsibility because of their social deprivation and marginalisation.
