{"id":32204,"date":"2016-04-12T00:00:00","date_gmt":"2016-04-12T00:00:00","guid":{"rendered":"https:\/\/cms.fiveaa.com.au\/uncategorized\/david-penberthy-and-will-goodings-challenge-stephen-mullighan-over-footpath-bike-laws-2\/"},"modified":"2016-04-12T00:00:00","modified_gmt":"2016-04-12T00:00:00","slug":"david-penberthy-and-will-goodings-challenge-stephen-mullighan-over-footpath-bike-laws-2","status":"publish","type":"post","link":"https:\/\/cms.fiveaa.com.au\/show\/david-penberthy-and-will-goodings-challenge-stephen-mullighan-over-footpath-bike-laws-2\/","title":{"rendered":"David &#038; Will challenge Mr Mullighan over footpath bike laws"},"content":{"rendered":"<h3>David Penberthy and Will Goodings have challenged Transport Minister Stephen Mullighan on FIVEAA breakfast, telling the minister that if an elderly citizen is injured or worse by a cyclist riding on a footpath, \u201cthat is going to be on your head\u201d.<\/h3>\n<p>After two pedestrians were struck and injured by cyclists riding on footpaths in separate incidents, David Penberthy told Mr Mullighan that there was no excuse for letting people speed on footpaths.<\/p>\n<p>\u201cThat is so irresponsible,\u201d Penbo fumed. \u201cIf it wasn\u2019t a 30-year-old woman, if it was an 80-year-old lady who got hit by that cyclist who was doing more than 40km\/h, that is going to be on your head,\u201d he said.<\/p>\n<p>\u201cYou can frame it like that, David,\u201d Mr Mullighan replied. \u201cAnd by the same logic you could ask me to ban certain classes of more dangerous vehicles from our roads because it\u2019s likely to increase the seriousness or severity of accidents.\u201d<\/p>\n<p>\u201cThis is about getting the balance right so that we make sure people have got transport options that they can get around our community,\u201d Mr Mullighan said.<\/p>\n<h3>LISTEN TO STEPHEN MULLIGHAN HERE:<\/h3>\n<p><iframe loading=\"lazy\" frameborder=\"no\" height=\"166\" scrolling=\"no\" src=\"https:\/\/w.soundcloud.com\/player\/?url=https%3A\/\/api.soundcloud.com\/tracks\/258693330&amp;color=ff5500&amp;auto_play=false&amp;hide_related=false&amp;show_comments=true&amp;show_user=true&amp;show_reposts=false\" width=\"100%\"><\/iframe><\/p>\n<h3>\u201cThese laws have been in for several months now and we\u2019re talking about two incidents that have been reported to the media,\u201d Mr Mullighan said.<\/h3>\n<p>\u201cWill accidents happen on footpaths? Yes they will. We can\u2019t legislate to make sure that people don\u2019t engage in thoughtless or other behaviour.<\/p>\n<p>\u201cThese will happen from time to time, but this is getting the balance right,\u201d he said.<\/p>\n<p>Penbo was left stunned when Mr Mullighan said he would \u201cabsolutely\u201d leave the footpath laws as they are.&nbsp;<\/p>\n<p>\u201cWe\u2019ve got very stringent requirements on how cyclists have to behave,\u201d Mr Mullighan said. \u201cSometimes cyclists do the wrong thing just like every single day out on most roads a lot of drivers do the wrong thing as well.\u201d<\/p>\n<p>Mr Mullighan also said footpath behaviour had been the responsibility of councils for decades.<\/p>\n<p>\u201cYou\u2019re the government, why do you want to hand it off to them?\u201d Penbo asked.<\/p>\n<p>\u201cWe\u2019ve had a long standing legal responsibility by councils for managing behaviour on footpaths.
